1. About these terms
Home Mapper Now (the app) is made by David Sablatura, 9201 Brodie Lane, Austin, TX 78748, support@homemappernow.com (the developer, we, us). These terms govern your use of the app and the server it talks to. By tapping I agree, or by using the app, you accept them. If you do not accept them, do not use the app.
This is beta software distributed for testing. It can change, stop working or be withdrawn at any time, and it may contain errors.
2. What the app is, and what it is not
The app is a drafting aid. It helps a professional draw a diagram of a building from public map records, from AR measurements taken with the phone, or from measurements typed in by hand.
It is not a land survey. It does not determine boundaries, property lines, easements, setbacks or lot size. It is not an appraisal, an insurance or lending document, an engineering or architectural drawing, a building code review, an inspection, or legal advice. It does not detect pests or decide the scope of an inspection; every marker, label or code on a diagram was placed by the person using the app.
It is not the Texas Official Wood Destroying Insect Report (Form SPCS/T-5). A diagram is meant to be attached to a report that the licensed inspector completes and signs.
The app is not made, reviewed, approved or endorsed by the Texas Department of Agriculture or any other government body or data provider.
3. Accuracy: you check everything
Outlines from an address lookup are copied from published records. They may be out of date, off by many feet, include roof overhang, miss an addition or belong to a different building. AR measurements depend on the phone's sensors and how carefully you tap each corner, and are not survey-grade.
Before any dimension, area or diagram is used in a report, contract, loan, insurance file, permit or dispute, verify it with a tape, a laser or another suitable method. If you switch off a diagram's footer, the note that it is approximate and not a survey stops printing on it, and you are responsible for keeping that note with the diagram.
4. Your responsibility
You are responsible for holding any license your work requires, for following the rules that apply to it, for what you put in a report you sign, and for having permission to be on a property and to scan it. Take care when you walk while you measure.
5. Acceptable use
Do not use the app unlawfully, present a diagram as a survey or as an official government document, or overload or disrupt the server or the public services it relies on. We may limit or block use that does.
6. Your diagrams and what you send us
Your diagrams are stored on your phone and you own them. We do not have a copy unless you send one in a bug report. If you delete the app they are deleted with it, so keep your own backups.
When you send a bug report you allow us to use it to investigate and fix problems.
7. Third-party data
Address lookup relies on public records and services run by others. They are provided as they are and can change or disappear. See Data sources.
8. No warranty
TO THE FULLEST EXTENT THE LAW ALLOWS, THE APP AND EVERYTHING IT PRODUCES ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE (INCLUDING ANY INSPECTION, SURVEY OR VALUATION) OR NON-INFRINGEMENT.
9. Limits on liability
TO THE FULLEST EXTENT THE LAW ALLOWS, THE DEVELOPER IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, LOST PROFITS OR DATA, OR CLAIMS BROUGHT BY YOUR CLIENTS OR ANY THIRD PARTY (SUCH AS A HOME BUYER, SELLER, LENDER OR INSURER) ARISING FROM USE OF OR RELIANCE ON THE APP OR ITS DIAGRAMS.
THE DEVELOPER'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR THE APP IN THE PRECEDING TWELVE MONTHS OR US$50. Nothing here excludes liability that cannot be excluded by law.
10. Your indemnity
You agree to defend and hold the developer harmless from claims and costs arising from your professional work using the app, the reports and diagrams you deliver, your entry onto a property, or your breach of these terms.
11. Changes, ending, law and contact
We may update these terms; when they change materially the app asks you to accept the new version. We may suspend or end the app or the server at any time, and you can stop at any time by deleting the app. Texas law governs these terms, and disputes go to the state or federal courts located in Texas.
